Whilst the upmost care and attention is given to all semen collected, frozen and stored, Fit and Fertile or any of their trading partners or personnel are not liable for any loss, delay, damage of any semen stored, imported or exported. As Semen is classed as a perishable item it is not insurable.
We ask when arranging for canine semen to be shipped that you obtain the latest health regulations for the Country the semen is being exported to be provided to Fit And Fertile Ltd.
Fit and Fertile accept no responsibility for any changes, updated information according to the export.
When exporting and importing canine semen delays can occur due to Courier services, Customs and Border Inspection departments which are not within Fit and Fertile’s, sender or receiver’s control. Every effort is made by Fit and Fertile to help assist and chase consignments in these situations.
Semen storage is charged on the anniversary of the semen collection date and 7 days payment is required by card or directly into Fit And Fertile’s bank account. Please ensure your invoice number or your name is stated as the reference. Late payments are also subject to a late payment charge of 5% per month of the invoice total. Should payment not be received after 12 months the semen will be automatically destroyed without further notice.

Accuracy of Content
We have taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT. If the price of the goods increases between the date we accept your order and the delivery date, we will let you know and ask you to confirm by e-mail that the new price is acceptable. If it is not acceptable, then you will of course have the right to cancel your order. Any weights, dimensions and capacities given about the goods are approximate only. To the extent permitted by applicable law, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website and we shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials contained on this website.
All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.
Your card payment is taken at the time of ordering via telephone or web shop. We will charge your credit card account for payment upon receipt of your order unless delivery cannot be fulfilled within 30 days. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from your account then we can cancel the contract and or suspend any further deliveries to you. This does not affect any other rights we may have.
Delivery charges vary according to the type of goods ordered. Please accept that we are unable to refund any cost for postage that you may have paid, unless we have sent you an item incorrectly or the item is deemed to be faulty.
We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions. We aim to despatch all authorised orders World-wide within 1 working day. Working days are Monday to Friday. However, there may be circumstances beyond our control which delay delivery. We cannot be held responsible for any delays caused by our couriers.
Risk & Ownership
The risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.
Acknowledgement & acceptance of your order
You will need to provide us with your e-mail address and we will notify you by e-mail as soon as possible to confirm receipt of your order. An acceptance of your order will take place on despatch of the good(s) ordered.
Under the Distance Selling Regulations, you have a right to cancel your order for any item purchased for a full refund within 7 days of receipt of goods. To cancel, you can email or write to us within seven working days of delivery of your order, quoting your order number. You must not use your items and must return them unopened and in the original packaging. A refund of the cost of the goods, excluding carriage charges, will be sent to you within 30 days.
Please check that you have ordered correctly and received the right products as soon as they arrive. Due to the nature of the goods we regret that we cannot exchange any goods once the tamper evident container has been opened. If you have ordered the incorrect goods in error, we will replace them providing they are returned in good condition and unopened within 14 days of receipt, but this will incur a postal charge. It is important to us that you are satisfied with our service. If you need to return goods to us for any reason more than 7 days after receipt, we will normally issue you a credit note for the value, providing that the goods are unopened, in good condition and have a shelf life that is in excess of 6 months of their expiry or use by date. Before returning any goods to us you must contact us to be given a Return Merchandising Authorisation (RMA) number.
Loss or Damage
Occasionally goods may be lost in the post and we will send a replacement order when this occurs. However Royal Mail does not accept that a delivery is lost until 7 working days following dispatch. We therefore only send replacements after this period has elapsed. In all cases we must be informed of non-arrival, damage or shortages within 14 days of the order being placed otherwise no claim can be made or replacement goods sent.
You can order goods on our website to be sent direct to you from the UK, be aware that in many countries the products do require import or quarantine permits before they will be allowed entry. They may also be subject to import tax payments. Therefore any goods being sent from the UK to overseas destinations are sent entirely at your own risk and we accept no responsibility once they have left our warehouse.
Changes to Legal Notices
We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.
Law, Jurisdiction & Language
This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
